Terms of Service

General terms and conditions as well as delivery and payment conditions - status 01.01.2022

It is important to us that your order and delivery are processed to your satisfaction. We would therefore like to ask you to observe the following information:

Price and delivery conditions:

The prices are per bottle as the final price, unless otherwise stated. Subject to price errors.
The delivery time is 2-5 working days
We already deliver from 1 bottle and assorted packages without surcharge.

  • Free delivery/shipping from €75

  • Delivery in the municipal area and a radius of 35 km free of charge

We charge a flat rate of €6.99 for packaging and freight.

Deliveries abroad are made on request and only against prepayment. The freight costs actually incurred will be passed on. If you would like to collect your order from us, we ask that you notify us in advance so that we can prepare the wines for you and you do not have to wait. Please dispose of empty bottles and cartons at your local disposal facilities.

Year and supplier change:

Dates of birth in the text are authoritative. The information in the online shop may vary. If two vintages are specified, the vintage named first is always sold first. We will inform the customer in advance of any changes in the vintage and obtain their consent. We reserve the right to change suppliers, change individual additional predicates and change individual bottle designs.

Conclusion of the contract:

The following terms and conditions also apply to all contracts that are initiated using means of distance communication (telephone, e-mail, etc.):
The initial order must be made in writing by email or personal message. In the event of a query if anything is unclear, we ask that you provide your telephone number or e-mail address. With an order, our terms of delivery and payment are accepted. New customers expressly accept our terms of delivery and payment with their first order. The contract is concluded exclusively in German.

Goods inspection/breakage/lack of quantity/cork wines:

You should definitely have the driver/delivery agent acknowledge any damage and shortages on the delivery receipt and let us know so that we can claim the damage from the insurance company. Your warranty or compensation rights remain unaffected. Despite all care, it can happen that a wine is corked or tilted (spoiled). In this case, please contact us and then send us the bottle (min. 500ml) back - please close it tightly. Upon receipt, we will inspect the goods and, if the defect is confirmed, promptly replace them by credit note or replacement.

Invoicing and payments:

You will receive the invoice with the goods or by e-mail, which must be paid within the specified payment period. You can pay in cash, by PayPal or on account. The goods remain our property until full payment. If the customer is a merchant, our place of business is deemed to be the place of jurisdiction and place of fulfillment for all legal disputes arising from the underlying contract. For the consumer, our place of business is the place of performance for the payment.

Wein & Schmankerl Emmeran Sanktjohanser is registered with the packaging register LUCID under number DE3517074847603

Wein & Schmankerl Emmeran Sanktjohanser is registered with Landbell GmbH (Society for Sustainable Circulation Economy mbH) under customer number 4220938. Wein & Schmankerl Emmeran Sanktjohanser transfers amounts for the return system for sales packaging to Landbell AG every six months, thereby fulfilling its obligations under the Packaging Ordinance.


Right of withdrawal

Right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving a reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of the revocation:

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. The costs are estimated at a maximum of around €10 per box of 6.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Small business regulation:

The prices given are final prices plus shipping costs. According to § 19 UStG we do not charge sales tax and therefore do not report it (small business status)

Alternative dispute resolution according to Art. 14 Para. 1 ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (OS), which you can go to  find. Consumers have the option of contacting [name, address, website of the arbitration board] to resolve their disputes. We are obliged to participate in dispute resolution procedures before this body. We will take part in such a procedure.
